What is AB 1033?

For years, you could build an ADU — a second unit on your property — but you could only rent it. You couldn’t sell it on its own.

AB 1033 changed that. This California law lets cities allow a newly built ADU to be sold separately, with its own deed — like a condo, but detached and private. In practice, that means a brand-new category of home: priced like an entry point, but it lives like a house.

What do I actually own?

The home and its deed — outright. It’s real property ownership, the same kind of title you’d hold on any home you buy.


How is this different from a regular condo?

Most condos share walls, share utilities, and come with HOA fees. An AB 1033 home is detached, has its own utilities and parking, and has no HOA. You get condo-style ownership in a single-family-style home.


Do I pay HOA fees?

No. That’s one of the biggest differences — and one of the first things our buyers notice.


Where is this available?

AB 1033 only applies in cities that have adopted an ordinance to allow it. San José is live, and more Bay Area cities are moving. Tell us your city.
