What is Condominium Conversion in San Jose?
In California, a condominium conversion—also known as a condo conversion—is the legal process of converting a property that has multiple units under a single title (for example, a primary residence with one or more accessory dwelling units) into individually owned condominium units with shared common areas.
ADU Condominium Conversion in San José
Since June 2024, San José has been the first city in California to allow the sale of accessory dwelling units (ADUs) as separate condominiums.
This means that if you have a legal, permitted ADU, you may convert it into a standalone condominium unit—completely separate from your primary residence. Once the ADU is individually ownable and conveyable, it can be sold as its own unit, with a separate address, property tax bill, and title—just like a traditional condominium.
Previously, an ADU could only be sold separately from the main residence in very limited circumstances (such as if it was developed by a qualified nonprofit).

How does it work in San Jose?
Preliminary Assessment:
Complete the City’s ADU Condominium Checklist: Assemble all required documentation, including confirmation of permitted ADU status.
Application & Documentation
Submit a Parcel Map application to Public Works: The map subdivides your property into separate condominium ownership interests.
Provide the following documents:
- Property owner’s written and signed authorization (if applicant is not the property owner)
- Lienholder’s written consent (if property has a lien, loan, or mortgage)
- HOA’s written authorization (if there is an existing HOA)
- Condominium Plan
- Site Plan (attached to Condominium Plan)
- Utility Will Serve Letters
- Bylaws and CC&R’s prepared and that apply to each owner
Recordation & Final Steps
Request a new municipal address for the ADU (no longer just “Unit X”) by submitting an Address Assignment Request Form, include your approved permit and Parcel Map information as part of the submittal
