SAN JOSÉ, California (August 14, 2025) – AlphaX RE Capital, through its specialized housing brand Apex Homes, has completed California’s first ever Accessory Dwelling Unit (ADU) condominium conversion in partnership with the City of San José. Enabled by AB1033, the new state law that allows ADUs to be sold separately from a property’s main residence, the project marks a breakthrough in affordable homeownership.

The Joséfa Street project near downtown San José, approved by Mayor Matt Mahan and city leaders, demonstrates how ADU condominiums can expand pathways to ownership at more accessible price points. Families priced out of single family homes now have a new opportunity to invest in stability and wealth building.

Efficiency and Impact

The City of San José demonstrated the potential of AB1033 by completing the Joséfa Street parcel map review in just 60 days. AlphaX RE Capital completed its application review in 29 days, showing how policy and private innovation can work together to accelerate housing solutions.

City Leadership and Commitment

San José has doubled ADU permits in the last five years, issuing more than 1,500 permits since 2022 and completing over 1,100 approvals. With tools such as the ADU Condominium Checklist and a dedicated “ADU Ally” team, the City continues to lead in making these projects viable.
“ADUs are affordable by design and growing in popularity across the state, and now they can offer the most accessible form of home ownership too,” Mayor Matt Mahan said in a statement, saying the city’s ADU condo sale approval is a “proof of concept for California.”
